Kindbody recognizes the Supreme Court’s recent decision to overturn Roe v. Wade may have created uncertainty and concern for members of our community surrounding the future of fertility care.

We have created this resource page to help provide answers to questions you may have surrounding this decision. We will continue to update this page as more information becomes available. We assure you that we are prepared to act swiftly to support you and we will do whatever we can to protect your rights as a patient.

We are working with both local and national organizations to monitor the situation and will update you as more information becomes available. We stand with RESOLVE, the American Society for Reproductive Medicine (ASRM), and the American College of Obstetricians and Gynecologists (ACOG), who have been hard at work to protect patients’ reproductive rights at both the national and state levels.

Posting on social media is great but calling or meeting with your legislators is most effective. This page will help you find your elected officials: Find your legislators. If you live in a state that has a trigger law or a proposed personhood law or a law banning abortion, reach out to your state level legislators, as they will be the ones to vote on those laws. The best way to reach out is with a phone call. Many of our elected officials are not aware of how these laws can impact fertility care so your calls truly can make a difference!

This toolkit from ASRM provides you with a process for how to advocate for yourself.

Don’t know what to say? Use this sample script as a guide:

“Hello, my name is [X], and I’m calling from [City, State] and I am a constituent of [Senator/Congressman/Congresswoman X]. I’m calling in [opposition/support] of Bill Number XX.”

You can feel free to end here and just give your phone number! OR! You can give a sentence or two in explanation of why you oppose or support the bill:

“I am an IVF/infertility/fertility patient and I am concerned that Bill Number XX will have a negative impact on my ability to receive the care my physician has determined is necessary for me to build my family. Thank you so much.”

The person who answers the phone will likely want to gather some demographic information so that the legislator can respond to you.

At this time, we do not anticipate any impact on your ability to receive IVF care. However, there is uncertainty surrounding the impact of some states’ trigger laws and pending legislation on IVF and the management of miscarriage and ectopic pregnancies. We are monitoring this situation closely along with ASRM to evaluate any potential impact on your care. We assure you that we are prepared to act swiftly to support you and we will do whatever we can to protect your rights as a patient.

The current restrictions have no impact on IVF or reproductive health services. On June 29th, ASRM released a review of current state trigger laws and their potential impact on reproductive care. You can find it here: ASRM Report on Impact of State Trigger Laws on Reproductive Medicine.

We will continue to work with ASRM to provide updates on how new access to abortion care laws may impact IVF care in your state.
